Terms of Service (Early access program, Affiliate program)

Welcome to Tapform. These Terms of Service ("Terms") govern your access to and use of the services provided by Tapform through our websites (tapform.com and tapform.io), including any associated software, widgets, content, features, or other services we may offer from time to time (collectively, the "Service"). Please read these Terms carefully before accessing or using the Service. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Eligibility and Account Registration

You must be at least 18 years of age or the age of legal majority in your jurisdiction to use Tapform. By registering for an account or otherwise using the Service, you represent and warrant that you meet these eligibility requirements and that any information you provide during registration or usage is truthful, accurate, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

2. Description of Services

Tapform is a software-as-a-service (SaaS) platform that allows users to create, manage, and distribute interactive, wizard-style forms ("Forms") used primarily for lead collection, qualification, and engagement. Forms may be deployed on websites via widgets, shared via public links, or used through custom domains (CNAME). Access to features and usage limits varies depending on your subscription plan.

3. Subscription Plans, Billing, and Payments

Tapform offers both free and paid subscription plans. The free plan does not require payment information and includes a limited set of features and usage allowances. Paid subscriptions unlock additional features and limits as described on our pricing page. Subscriptions are billed through our third-party payment processor, LemonSqueezy, who acts as the merchant of record.

3.1 Trials and Billing

Tapform may offer a free trial period for paid subscriptions, which will be clearly displayed at the time of checkout. Trial lengths may vary and are subject to change without prior notice to new users. Once the trial period ends, unless canceled, you will be automatically charged for the applicable subscription fee.

3.2 Price Changes

We may modify our subscription fees at any time. Such changes will be communicated in advance to existing paying customers. Continued use of the Service after the fee change constitutes your acceptance of the new fees.

3.3 Refund Policy

Customers are entitled to request a refund within 14 calendar days of their initial subscription purchase. Refunds are processed exclusively through LemonSqueezy. To request a refund, you must send an email to [email protected] including your order details and reason for the request. Refunds outside of the 14-day period are not guaranteed.

3.4 Dunning and Suspension

If payment for a subscription fails, the customer enters a 10-day dunning period. During this period, Tapform will attempt to collect payment. After this period, if the payment remains unsuccessful, the account may be suspended or downgraded until the outstanding balance is resolved.

4. User Responsibilities and Acceptable Use

Users agree not to use Tapform to engage in any unlawful, fraudulent, or harmful activity. This includes, but is not limited to: infringing intellectual property rights, collecting data without consent, spamming, or using deceptive tactics to acquire leads. Tapform reserves the right to investigate violations and suspend or terminate accounts that breach these Terms.

5. Intellectual Property Rights

All content, software, and features of the Service, excluding user-submitted content, are the property of Tapform or its licensors. Tapform grants users a limited, revocable, non-exclusive, non-transferable license to use the Service in accordance with these Terms. Any feedback provided to Tapform may be used for product development without compensation or restriction.

6. User-Generated Content

You retain all intellectual property rights to the content you submit, upload, or otherwise make available through the Service ("User Content"). While Tapform does not claim ownership over your User Content, you grant Tapform a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, reproduce, adapt, publish, display, perform, and create derivative works from such content for the purpose of operating, improving, and promoting the Service, in accordance with your privacy preferences and our Privacy Policy. This license may be revoked at any time by deleting your User Content or closing your account, except to the extent Tapform has used it in connection with promotional or sponsored material still in circulation.

7. Data Handling, Security, and Privacy

Tapform does not sell, share, or disclose user or lead data to third-party advertisers. However, we use reputable third-party services including but not limited to Google, Meta, Microsoft Clarity, MailerSend, PostHog, Amplitude, OpenAI, LemonSqueezy, and Vultr to deliver our Services. While we implement industry-standard security practices, no system can be guaranteed to be 100% secure. By using Tapform, you acknowledge this risk.

8. Limitation of Liability and Disclaimers

The Service and all materials provided through it are offered on an "as is" and "as available" basis. To the maximum extent permitted by law, Tapform makes no representations or warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event shall Tapform or its suppliers be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, even if Tapform has been advised of the possibility of such damages. "Consequential loss" includes, but is not limited to, indirect loss, loss of anticipated savings or benefits, business interruption, reputational damage, or loss or corruption of data, whether arising under statute, contract, equity, tort (including negligence), indemnity, or otherwise. Certain jurisdictions do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you may have additional rights.

9. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or if required to do so by law. Upon termination, your license to use the Service will cease and your data may be permanently deleted.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Croatia. Any disputes arising under these Terms shall be resolved exclusively in the courts of Croatia.

11. Dispute Resolution

In the event of a dispute, both parties agree to attempt resolution through good-faith negotiations. If unresolved, disputes shall be subject to binding arbitration under Croatian law, with arbitration held in Croatia. Each party shall bear its own costs unless otherwise determined by the arbitrator.

12. Widgets and User Content

By submitting personal data through a Tapform widget or form, users consent to sharing such data with the Tapform user or workspace owner. Tapform is not responsible for the actions of these recipients or any subsequent communications. Users agree to indemnify and hold Tapform harmless from any liability arising from such interactions.

13. Changes to Terms

We may revise these Terms at any time. We will notify users of significant changes, and continued use of the Service after such changes constitutes acceptance.

15. Acceptable Use Policy

Tapform users must use the Service in a responsible, lawful, and ethical manner. You are prohibited from using the Service to conduct or support activities that are illegal, abusive, exploitative, or interfere with the operations or security of Tapform or third parties. This includes, but is not limited to, the distribution of malware, phishing, unauthorized access to systems or data, spam, intellectual property violations, hate speech, and content related to pornography, election interference, or prohibited industries such as weapons or narcotics trafficking.

All customers are responsible for their own use and for ensuring that end-users and third parties using the Service on their behalf comply with this policy. Unfair or excessive usage outside the scope of normal business activity may lead to limitations or additional charges. Customers are also responsible for preventing unauthorized access to their accounts by implementing appropriate security practices.

Any attempts to impersonate Tapform, claim unauthorized affiliation, or misuse the Tapform brand or infrastructure for deceptive purposes are strictly prohibited. Tapform reserves the right to investigate and take action on violations, which may include suspension or termination of access, legal proceedings, and notification to relevant authorities without prior notice.
